Secret Trademark Use

A client recently asked whether their company could register
a trademark that was only used internally.
The answer is: probably not.

The reason: trademark rights in the U.S. arise from their use in
commerce. Purely in-company use of a
mark is considered to be a “secret use” and thus does not support the
registration of the mark.
